"Unreasonable and Illogical"

As a follow-up to my last post, I notice that a three judge panel just ruled (and it hardly needs any further commentary):

[Erik Hjelle] testified repeatedly that by using the phrase “Maplewood Police and Fire Endorse Rebecca Cave,” he intended to communicate that Ms. Cave had the support of all Maplewood firefighters. Neither Hjelle nor the MFA have the authority to speak for the Department or the MPFA, and the evidence is undisputed that neither of these organizations has agreed to endorse Ms. Cave . . .

Mr. Hjelle testified that he relied on the Fire Chief’s apparent permission to allow paid-per-call firefighters to use the phrase “Maplewood Fire” on T-shirts and other apparel as the basis for believing that he could use the same phrase in an endorsement. This extrapolation is unreasonable and illogical, as are his efforts to seek trademark protection, on his own behalf, for a phrase and logo used by the City of Maplewood to identify its Fire Department.

Update: The OAH now has the text of the judges' findings in easy-to-browse HTML.

    Oops

    The Eight Commandment

"You shall not bear false witness against your neighbor."

The eighth commandment forbids misinterpreting the truth in our relations with others. This moral prescription flows from the vocation of the holy people to bear witness to their God who is the truth and wills the truth.

    Is this one safe?

9:11 And I will establish my covenant with you; neither shall all flesh be cut off any more by the waters of a flood; neither shall there any more be a flood to destroy the earth.

9:12 And God said, This [is] the token of the covenant which I make between me and you and every living creature that [is] with you, for perpetual generations:

9:13 I do set my bow in the cloud, and it shall be for a token of a covenant between me and the earth.

9:14 And it shall come to pass, when I bring a cloud over the earth, that the bow shall be seen in the cloud:

9:15 And I will remember my covenant, which [is] between me and you and every living creature of all flesh; and the waters shall no more become a flood to destroy all flesh.

9:16 And the bow shall be in the cloud; and I will look upon it, that I may remember the everlasting covenant between God and every living creature of all flesh that [is] upon the earth.

    oh, my.

17:10 This [is] my covenant, which ye shall keep, between me and you and thy seed after thee; Every man child among you shall be circumcised.

17:11 And ye shall circumcise the flesh of your foreskin; and it shall be a token of the covenant betwixt me and you.

17:12 And he that is eight days old shall be circumcised among you, every man child in your generations, he that is born in the house, or bought with money of any stranger, which [is] not of thy seed.

17:13 He that is born in thy house, and he that is bought with thy money, must needs be circumcised: and my covenant shall be in your flesh for an everlasting covenant.

17:14 And the uncircumcised man child whose flesh of his foreskin is not circumcised, that soul shall be cut off from his people; he hath broken my covenant.

Erik, Erik, Erik! I thought you were smarter than that. I thought you might have learned your lesson the last time you got mixed up in campaign practices tomfoolery.

When will the three of you learn? There is no one out to get you. The people who are against you are really in that position because you can't figure things out for yourself.

The sooner you learn to play by the rules, the real rules, not the ones in dianna's twisted version of reality, the easier (and more prosperous) your lives will be.

All I can say is bravo, somebody finally got it right and is holding Cave and Hjelle accountable for their loose interpretation of the campaign rules.

What I cannot figure out a handful of firefighters would follow Ms Cave around and support her like she is the Queen Mother. I mean common, she supports the fire, but how often does any council person anywhere vote agaist the fire department? Do they think her "leadership" will get them all put to full time status, complete with City pay and benifits? Hey anything is possible I guess.

Maybe they all like her because she just hangs out at the fire hall and bakes them cookies or helps them polish the truck.

In any event it will be interesting to see what the 3 do as lame ducks the last few meetings of the year. My guess is they give Copelund an even bigger contract so when he gets canned in January he will get an even bigger exit package. What are your guesses?

    Otto:

I too am afraid of the power rush the 3 will have in the last two months. It might be scary. Like a two year old after a 16oz bottle of Code Red. I could see Copeland with a bigger package ...er... contract.

And now, as of last night, we have a new public safety director. What kind of severance deal does he have? Did he know, going in, that the whole situation was in flux? Did he read the election results?

More money out the door next year...

So much for the savings plan of the 3 musketeers.

My guess is that Hjelle has bullied all of the other firefighters into supporting Rebecca. Bullying is what he is best at.

So when is somebody going to file a similar complaint about taxpayers footing the bill (City News) for Rebecca's blatant campaigning? And Mayor McCheese and Copeland blowing more sunshine and propoganda.

My favorite was her claiming how she brings new businesses to Maplewood. Like the new Walgreen's at Beam and White Bear. Gee Rebecca, once that opens, you don't suppose they're going to close the existing Walgreen's just down the road by Rainbow?

The appropriate place to file a complaint regarding Council Member Cave's campaigning vis a vis the City newsletter, would be with Terri Diamond at the State Auditor's office.

By all means, complain tothe auditor. It worked when Rybak did his campaign stuff in the city newsletter, and it cost the Rybak campaign $50,000. Granted, there were a lot more people who received the Minneapolis newsletter, but Maplewood has a higher percentage of people who can read.
